Policy on Copyright Infringement

Bare Medispa respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website that are reported to our Designated Copyright Agent identified below.

Procedure for Reporting Copyright Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit a notice to our Copyright Agent. To be effective, your notification must be a written communication that includes substantially the following information. Your notice must contain a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed. You must identify the copyrighted work claimed to have been infringed. You must also identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, and provide information reasonably sufficient to permit us to locate the material. Please provide your contact information, including your address, telephone number, and, if available, an email address. Your notice must include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. Finally, you must include a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Designated Copyright Agent

Your notice of claimed copyright infringement should be sent to our Designated Copyright Agent. You may contact our agent via email or physical mail at the contact information provided on our website's contact page, clearly marked for the attention of the Copyright Agent.

Counter-Notification Procedure

If you believe that your material that was removed is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notice to our Copyright Agent. To be effective, your counter-notice must be a written communication that includes the following. It must contain your physical or electronic signature. You must identify the material that has been removed and the location at which the material appeared before it was removed. You must include a statement under penalty of perjury that you have a good faith belief that the material was removed as a result of a mistake or a misidentification of the material. Your counter-notice must also include your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original infringement notification.

Policy on Repeat Infringers

In accordance with the DMCA and other applicable law, Bare Medispa has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers of copyright. We may also at our sole discretion limit access to the website and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
